HEALTH FUNDING

Fiona has been an advisor to health sector clients for approximately 30 years on contractual matters across an extensive range of primary health care funding contracts. This has included contract drafting, review and peer review, contract negotiations with sector and funder representatives, and contract and legislative interpretation.

Health sector contracts and legislation. Fiona's skill set includes:

  • An in-depth understanding of current and historical funding arrangements, operational requirements of the payment   systems and service-specific issues in each funding stream (such as pharmaceutical, maternity, and PHO capitation funding).
  • Information technology contract drafting for the health sector
  • Assessment of whether health service providers have complied with their contractual obligations.  Identifying enforcement and recovery options when they have not complied.
  • Litigation and Tribunal work: Representing the interests of the MoH in the precedent setting civil cases Hobson & Anor v Harding & Ors (the section 22G Health Act case establishing the right to access patient clinical information on audit), and Ministry of Health & Ors v Dalley (a civil recovery action). Assisting with health contract aspects of health practitioner Tribunal work.
  • Risk identification and mitigation.  Review of 140 individual health provider funding contracts from the $611m primary health funding stream of two District Health Boards.  This was part of the MoH Audit & Compliance risk assessment and review project. Suggestions for mitigation of risks identified were part of the service provided.
  • Risk Measurement Activities.  Legal assistance with preparation of the Audit & Compliance Loss and Risk Measurement Reports.  The Reports identified areas of potential risk in a significant funding stream, measured the likely levels of that risk and suggested appropriate mitigation activity.  District Health Boards implemented a significant number of the recommendations arising out of these Reports with savings estimated to be in the millions of dollars.
